Selecting a Mediator
Expedite Resolution Ltd maintains a panel of mediators. The responsibility of selecting a mediator, and deciding whether the background, qualifications and experience of any particular mediator is appropriate for any particular dispute is the responsibility of the parties and their advisers. Expedite Resolution Ltd does not accept any such responsibility. Any administration fee payable to Expedite Resolution Ltd as part of the mediation fee is intended to cover the cost of the administration. No part of such fee is in respect of Expedite Resolution Ltd selecting a mediator.
When Expedite Resolution Ltd provides enquirers with the names and or CVs of 3 or more mediators this does not amount to a warranty that those mediators are suitably qualified or experienced. The parties and their advisers remain responsible for this.
Professional Liability Indemnity Insurance
When a mediation takes place the mediation service is supplied by the mediator (or, where the mediator is a member of a firm or company, that firm or company). The appropriate body, therefore, to take out professional liability insurance, is the mediator (or his/her firm or company).
Expedite Resolution Ltd maintains its own professional liability insurance in respect of the administration of mediations and associated tasks.
Expedite Resolution Ltd conducts periodic checks to ascertain that Expedite Resolution Ltd mediators carry current professional liability insurance but Expedite Resolution Ltd cannot and does not warrant that any particular mediator (or his/her firm or company) is insured at any particular time.
The onus is on the parties and their advisers to satisfy themselves that the professional liability insurance carried by the mediator selected is sufficient and appropriate for the relevant dispute.
