Arbitration and Adjudication Fees – by negotiation

Preparation timeThe above fees include the preparation time shown, any pre mediation telephone discussions and correspondence, any follow up work should the parties not settle on the day of the mediation, and all administration.
Early settlement on the dayThe fee remains payable if the Parties settle before the expiration of the anticipated time allowed for the mediation.
OvertimeAdditional mediation time (after hours shown above): first hour, no charge; thereafter as shown in table, per hour, per party.
Extra reading timeAdditional reading time (over and above the hours shown above): £100 per hour, per party.
Travel expensesMediator’s travel expenses are capped at £150 for mainland UK.
Overnight expensesMediator’s overnight expenses are capped at £125, and for mainland UK, shall only be payable where the mediation proceeds beyond 7 pm and/or goes into a 2nd consecutive day.
Venue CostsCosts of venue/accommodation and refreshments etc are to be provided by the Parties. The minimum requirement is (a) a room which can accommodate all parties, their representatives and the mediator plus (b) an additional room, so that each party can have their own room. So a minimum of two rooms are required for a two party dispute, although a third room is also useful. Rooms should not be adjacent, unless the sound-proofing between them is very good.
Payment termsThe fees for a mediation shall be invoiced in advance and payable 3 working days prior to the mediation. The balance of any additional fees shall be payable within 28 days after the date invoiced. In the case of telephone mediations, fees are payable in advance by the Defendant, the Claimant being liable to pay their fee to the Defendant 7 working days prior to the mediation, subject to any alternative agreement between the parties.
Non payment of fees before the mediation If the fees are not paid prior to the commencement of the mediation the mediation will only proceed if the lawyers for all parties give professional undertakings that the fees will be paid within 28 days after the date invoiced.
Cancellation terms A fee of 50% of the agreed fee, but capped at £500 + VAT, shall be paid if the mediation is cancelled, unless cancellation takes place more than 7 days prior to the mediation in which case no fee is payable.
