A mediator is not a judge. You can talk to the mediator, in confidence, before the mediation starts. It is helpful to do so. Pick up the phone or e mail the mediator and ask him/her to phone you. The other party(ies) will be told that a pre mediation conversation has taken place but all matters discussed will remain confidential.
Also, please note that the mediator will often call for two pre mediation written position statements (one will be disclosed to the other party, the other being for the mediator’s eyes only).
