Tim Wallis, director of Expedite Resolution Limited, is an accredited mediator and a member of a number of mediation organisations that are accredited by the Civil Mediation Council. He also holds a Practising Certificate entitling him to practise as a solicitor. When practising as a solicitor he is regulated by the Solicitors Regulation Authority. When acting as a mediator or an Alternative Dispute Resolution Consultant for Expedite Resolution Limited, however, he does so as a mediator and not as a practising solicitor. Expedite Resolution is not a law firm, does not practise law and is not regulated by the Solicitors Regulation Authority.
Clients of practising solicitors (who are regulated by the Solicitors Regulation Authority) have statutory protections. As clients of Expedite Resolution are not clients of a practising solicitor they do not, therefore, have these particular protections. However, Expedite Resolution does not and will not hold client money. Further, Expedite Resolution does carry professional indemnity insurance. This is for a level of indemnity higher than the minimum specified by the Solicitors Regulation Authority.
When Frances McCarthy provides mediation services she does so as a practising solicitor and a partner of Pattinson and Brewer. Accordingly, clients who instruct Frances McCarthy in a mediation do have the statutory protections referred to above.
